Big Changes Coming to Las Vegas Real Estate Operations on August 17th
As of August 17, 2024, significant changes are being implemented for Las Vegas real estate agents due to a recent class action settlement. These changes will impact how buyers and sellers interact with real estate agents and how commissions are handled. It’s essential to understand these changes to make informed decisions about your home buying or selling process.
What’s Changing?
Buyer Brokerage Agreements: Starting August 1st, all buyers will need to sign a Buyer Brokerage Agreement before seeing homes. This agreement outlines the terms of the buyer-agent relationship, including the agent's compensation. Importantly, buyers now have the ability to negotiate their agent's commission directly.
Seller Compensation: Sellers will no longer be required to offer compensation to the buyer's agent. This means the MLS will no longer facilitate these payments. Sellers should expect buyer's agents to request commission in the purchase agreement or for buyers to request seller contributions towards buyer closing costs.
Purchase Agreement: Buyer's agents can now request compensation from the seller, but only up to the amount agreed upon in the Buyer Brokerage Agreement. No additional compensation will be allowed.
Buyer Costs: Due to these changes, buyers may find themselves responsible for covering their agent's commission directly. This highlights the importance of hiring an experienced agent with a proven track record of negotiation.
